In the case I read about, the objection that eBay had was the use of eBay in their domain name. So the site just changed the domain name, and site name, but still has the same contents.

So http://www.ebayguitarscams.com/ is now just plain old http://www.guitarscams.com/. The content of the site didn't change, just the name. They can talk about eBay; they just can't name their site after eBay.
